Bridge Labs Technology, Inc. Terms and Conditions (T&C)
1. Scope of Service and Use
1.1. Service Description
Bridge Labs provides an AI-powered platform for candidate assessment, recruitment, and selection, designed to streamline processes and offer data-driven insights through the analysis of candidate responses and video interviews. The AI models primarily analyze the quality of the response/results in a sustainable and reproducible manner, rather than evaluating behavior or sentiments.
1.2. AI Output as Recommendation
The Client acknowledges and agrees that all scores, rankings, predictions (e.g., Matchability Score, Candidate Score), and insights generated by the Service’s Artificial Intelligence (AI) algorithms are explicitly recommendations and shall not be used to make fully automated employment decisions without meaningful human review. Therefore, the client must maintain human oversight and judgment throughout the hiring process, especially for final decisions.
1.3. Prohibited Use of AI Functionality
The Client shall not use the Service, nor attempt to configure it, to execute any activities explicitly prohibited under applicable laws, including but not limited to the EU AI Act. This prohibition includes, but is not limited to, using the Service to:
- Infer sensitive attributes from biometric data.
- Evaluate emotions in the workplace.
- Score people based on social behavior or personal traits.
1.4. Privacy Policy Incorporated by Reference
All data processing and handling of PII, video interview files, transcripts, and AI-generated analytical outputs are governed by the Bridge Labs Privacy Policy, which forms an integral part of these Terms and Conditions.
2. Client Obligations and Compliance
2.1. Compliance with Employment Law
The Client is solely responsible for ensuring that its use of the Service, including all hiring, promotion, or termination decisions supported by the Service, complies with all relevant federal, state, municipal, and international employment and anti-discrimination laws. This includes, but is not limited to, the US Equal Employment Opportunity Act (EEOC), the Americans with Disabilities Act (ADA), and Title VII of the Civil Rights Act.
2.2. Legal Liability
The Client acknowledges that, in jurisdictions such as the US, employers are held just as liable as vendors for any negative outcomes, such as discriminatory recruitment practices or legal violations, related to the use of AI recruiting tools.
2.3. Anti-Bias Measures
The Client must implement rigorous governance and compliance reviews. The Client shall actively work to prevent automation bias, defined as giving undue weight to AI-generated recommendations, by ensuring human oversight remains central to all decisions involving bias risk or ethical complexity.
2.4. Regulatory Mandates
The Client must comply with specific regional transparency and audit requirements, including:
- New York City Law 144: Ensuring the tool undergoes annual bias audits and providing notice to job candidates.
- GDPR/EU AI Act: Adhering to the stringent requirements for high-risk AI systems, including establishing accountability, non-discrimination standards, and adhering to compliance deadlines.
- Candidate Disclosure:Proactively informing candidates about AI's role in the hiring process, including what factors are being evaluated.
3. Intellectual Property (IP) and Data Use
3.1. Ownership
Bridge Labs retains all intellectual property rights to its proprietary AI models (e.g., Retention Analysis, Matchability Score) and the software algorithms used to generate analytical data (e.g., transcripts, scores, behavioral markers).
3.2. Feedback and Improvement
The Client agrees that anonymous and aggregated data derived from the use of the Service may be utilized by Bridge Labs for model improvement, general business reporting, and internal performance analysis, provided such use adheres to the Privacy Policy.
4. Indemnification and Limitation of Liability
4.1. Indemnification
The Client is responsible for hiring decisions and compliance, but Bridge Labs remains responsible for providing a lawful, compliant system. Therefore, the client agrees to indemnify and hold harmless Bridge Labs against any and all claims, fines, or legal actions (including but not limited to those based on disparate impact or discrimination) arising from the Client’s selection, misuse, or over-reliance on the AI outputs in making final employment decisions.
4.2. Limitation of Liability
Bridge Labs shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service. Bridge Labs’ core responsibility is to provide data and systems designed to aid decision-making, not to replace the Client’s final hiring judgment.
5. Termination
5.1. Termination for Non-Compliance
Bridge Labs reserves the right to suspend or terminate the Client’s access immediately if the Client is found to be in violation of any applicable legal or ethical guidelines related to AI use or anti-discrimination laws.
